1、論文摘要城市房屋拆遷是我國城市化進程中不可或缺的一部分，在城市建設中具有舉足輕重的作用，但是近年來，各地卻頻頻爆出拆遷所引發(fā)的惡性事件。究其根源，一方面是因為我國現(xiàn)行的法律法規(guī)仍缺少對拆遷程序的詳細規(guī)定，另一方面是由于當前的拆遷行政程序存在非正當性。2011年1月21日出臺并實施的《國有土地上的房屋征收與補償條例》，與之前的《城市房屋拆遷管理條例》相比，盡管在公共利益的界定等方面取得了相當大的進步，但對于拆遷程序的規(guī)定，仍有很多地方值得進一步商榷。在行文時，筆者采用理論聯(lián)系實際的方法，結(jié)合城市房屋拆遷糾紛的最新案例以及目前的相關(guān)法律法規(guī)，對我國現(xiàn)行的城市房
2、屋拆遷行政程序進行詳細解析，以深入探討我國城市房屋拆遷行政程序的正當性和合法性。本文主要分為五個部分，現(xiàn)分述如下：第一部分介紹了目前國內(nèi)外關(guān)于城市房屋拆遷程序的研究現(xiàn)狀，以及對文中的幾個核心概念——“行政程序”、“正當行政程序"、“城市房屋拆遷"和“城市房屋拆遷行政程序"進行了界定，同時簡要地介紹了筆者所采用的研究方法。第二部分為我國城市房屋拆遷行政程序的理論基礎——正當行政程序。主要論述了正當行政程序的理論淵源、基本內(nèi)涵和正當行政程序的一些基本原則。第三部分為我國城市房屋拆遷程序的現(xiàn)狀。著重介紹了兩個關(guān)于城市房屋拆遷糾紛的典型案例，并結(jié)合相關(guān)的法律法規(guī)，
3、對目前我國的城市房屋拆遷行政程序進行系統(tǒng)的梳理。第四部分為我國城市房屋拆遷行政程序中存在的主要問題。(一)公共利益界定程序的缺失；(--)拆遷過程中公眾參與的不足；(三)房屋征收補償程序顯失公平。第五部分為我國構(gòu)建城市房屋拆遷的正當行政程序提出一些建議。(一)設置具體的公共利益界定程序；(二)設置多元的公眾參與程序；(三)建立全方位的信息公開程序；(四)構(gòu)建公平正義的征收補償決定程序。關(guān)鍵詞：正當行政程序，城市房屋拆迂，行政程序ABSTRACTUrbanhousingdemolitionisanunavoidablepartofurbanconstruct
